BREAKING NEWS – Judge rules in favor of Crossroads Ventures – Again.

 

State Supreme Court Judge Richard Mott dismissed yet another of the lawsuits filed to try to stop Crossroads Ventures from building a resort complex under consideration for nearly two decades.
In a decision signed June 30, Mott dismissed and/or found no merit in all seven causes of action identified by the Catskill Heritage Alliance as it sought to overturn a decision by the Shandaken Zoning Board. Mott said claims of arbitrary and capricious actions were “without merit,” labeled the Zoning Board’s decision “rational,” said CHA failed to demonstrate a formal rule violation, & dismissed a charge that open meeting law was violated. He ruled an alleged conflict of interest for one planning board member without merit and said “given the ZBA’s rational conclusion that the habitational structures are a lodge development permitted in the subject zoning districts by special permit, the Approvals are also entitled to deference.” The full story and latest news on the project will appear in next week’s Catskill Mountain News, on stands and on line each Wednesday morning.
